341 MEETING OF CREDITORS

WHAT IS A 341 MEETING

The 341 Meeting of the Creditors a mandatory meeting that you must attend once you . The purpose of the meeting is for you the debtor to swear and affirm who you are; that you have read and approved your petition; if there has been a change of circumstances, and that you were informed of the consequences of filing before the Bankruptcy Trustee.

WHEN AND WHERE IS 341 MEETING HELD

The 341 Meeting is scheduled according to the court’s calendar within twenty to thirty days after your is filed. In the Western District of North Carolina (Charlotte Division) Chapter 7 341 meetings are typically held on Wednesdays at 10 am at 402 West Trade, Charlotte, NC 28204. Chapter 13 341 meetings are held on Tuesdays at the same location.

IS A DEBTOR REQUIRED TO ATTEND THE 341 MEETING

Yes you appearance is mandatory. You are required to attend the 341 Meeting. You should receive a notice in the mail with the exact date and time. If you fail to make it ot the 341 meeting, your case could be dismissed.

WHAT HAPPENS AT THE 341 MEETING

The trustee will first swear you in and then begin the meeting. The meeting is usually short and informal. In addition to the background questions, the trustee may ask either you or myself for additional documents or information if it is required.

DO CREDITORS EVER ATTEND THE 341 MEETING

Creditors rarely if ever physically appear at the 341 Meeting. Creditors do file notices of appearances with the court and can file motions without appearing at the 341 Meeting.

WHAT HAPPENS AFTER THE 341 MEETING

If you have a no-asset case, the Trustee will administratively close your case. Approximately sixty to ninety days after the 341 Meeting you should receive your discharge.
