PREPARING FOR BANKRUPTCY IN NORTH CAROLINA

1. Prepare documents
*Bank Statements for past 6 months
*Tax returns for the last two years
*Paystubs
*Pending Lawsuits to which you are a party
MAKE COPIES OF THESE DOCUMENTS for your Lawyer, preferably two copies, as your lawyer will most likely be sending a copy to the trustee.
2. Consult with an Attorney to verify that you qualify and if so which chapter
3. Make sure you understand the bankruptcy process. Your Attorney should discuss this with you during your initial meeting.
4. Be aware of your financial responsibility during the bankruptcy
*Which debts must you continue to pay after you file and during the automatic stay
*which debts will you continue to be responsible for even after the bankruptcy
5. Make sure you are fully informed of the fees
*Filing fee goes to the court and it is $299.00 for chapter 7 and $274.00 for Chapter 13
*Attorney’s fee is not included in the filing fee. Attorney’s fees for chapter 7 can range from $1,000.00 to $2,200.00. The fees for Chapter 13 can be anywhere from $2,400.00-$3,200.00
*Credit Counseling typically is about $35.00 per course per person.
6. Complete your Required Credit Counseling Courses
*You are required to complete a pre and post filing course. Typically, this course can be completed online in one or less.
7. Once your Attorney prepares your petition, be sure to carefully review it before it is filed. There is a fee for amendments to the petition once it is filed.
8. Once your petition is filed, check in with your Attorney to know if any further documentation or information is needed from you.
9. Be aware of the date of 341 Date. This is the time and day that you will be summoned to appear before the Trustee so that you can confirm that all the information in your petition is true and correct. Bring a copy of your identification to the 341 Meeting.
